FROM A MARTYR’S MOTHER TO OMER AL-BASHIR, THE KILLER OF HER SON

July 13, 2002

The Sudan Human Rights organization Cairo Branch (SHRO-Cairo) received a copy of a letter issued in London (July 13, 2002) by Mrs. Jara Osman Al Hussain, a Sudanese citizen in exile, to Omer Al-Bashir, the head of state, Khartoum.

The organization asks the Government of Sudan to abide-by international norms, as well as the laws of the Sudanese Armed Forces that penalize any falsification or wrongful disposal of martyr's rights.

The case of the Ramadan Martyrs is a major human rights violation. The Organization supports Mrs. Al-Hussain's complaint to officially charge with murder the army officers, including head of state Omer Al-Bashir whom she accuses of the killing of her son, and put them to a fair trial before Independent Judiciary.

Omer Hassan Al-Bashir The Republican Palace Khartoum (Sudan)

Subject:

(1) I reject your wicked conspiracy to use army forms to deliver compensation money to a false representative of the family of our Martyr Captain (pilot) Mustafa Awad Khugali. (2) Mothers do not take money from murderers of their sons. (3) Your trial before just and fair court is my lifetime goal.

I am writing this letter to you, Brigadier Omer Hassan Al-Bashir, and all the others who killed my son, Captain Mustafa Awad Khugali, without trial in the sacred month of Ramadan on April 24, 1990.

Army officer Omer:

You have assassinated my son, Captain (Pilot) Mustafa, in gross violation of the Sudanese Armed Forces Law that guarantees the right of the accused to receive with formal procedure accusation form in sufficient time to be able to prepare defense, find legal advise from the army or the Bar Association, and cross-examine witnesses before a non-secretive military court.

You have willfully and grossly violated all these State laws in April 1990.

You killed my son after a secretive meeting with your assistants whose terrorist names are well known, worldwide, for example Brigadier Elzubair Salih, Major Ibrahim Shamseldeen, Colonel Al-Khanjar, Colonel Kunna, and the other murderers.

Your assistants executed my son and his colleagues, the other officers and/or regulars, in the same wrongful manner. You and your assistants tortured and humiliated the martyrs who represent some of the bravest members of the Sudanese Army before they were finally shot in a secretive fire squad, although they were fasting Ramadan, then buried in an unknown place.

Brigadier Omer, the murderer of my son Captain Mustafa:

You have grossly violated the Constitution of Sudan because you made of yourself a leader of the Sudanese Army while the highest rank you could have possibly obtained, judged by your performance before and after your treacherous coup, according to professional reports made available to the Ramadan Martyrs’ Family League, was only an ordinary brigadier.

You abused the laws of the Sudanese Armed Forces after you assumed the office of Commander-in-Chief of the army because you killed your own army regulars in cold blood together with many innocent civilians, as the worst crime in the armed forces ‘ and the other State laws, simply to stay in power. This is not what any armed forces are made for in any respectable state on earth.

You have acted as a non-civilized non-human leader of the Sudanese Armed Forces when you wickedly ordered the killing of my son and his colleagues in the Holy Month of Ramadan that every Muslim, even many non-Muslims, know does not allow killing during its sacred month.

You sent your secretive police to harass me and the other members of Mustafa ’s family by daily police offensive visits early mornings and late evenings for a lengthy period of time to threaten us not to make demonstrations to protest the terrorizing crimes you committed against the Sudanese.

You and the other killers arbitrarily arrested and detained me with my daughters and their children, of whom a child was newly born, in illegal incarceration at the Omdurman Prison in poor conditions, for no reason. You and your unconstitutional government made it virtually impossible for us as a Sudanese family to live in our Homeland.

You compelled us to seek refuge with our sick and aged individuals as well as young people and newly born children to suffer the hardships of displacement in the most difficult conditions at the same time you have been cheaply imposing repressive rule upon the good nation of Sudan.

Since then, I have decided to live in exile, despite the bitterness of refugee conditions, to struggle with all determination to put you and the other killers on trial before a just and fair court because you were not only a brutal murderer. You also acted as coward leaders that would not bear to face out the results of their wrongful deeds.

You aggressively assaulted our peaceful demonstrations in the streets of Khartoum, the capital of our country that you‘ve shamelessly converted into a capital for international terrorists, serial killers, war dealers, and shameless thieves. With these unprecedented crimes, you have brought unprecedented shame unto our country.

You did not permit us, the families of the army officers and soldiers of the Ramadan Movement, to receive their wills, know where they were unlawfully killed and buried, or posses their belongings as is due by law, religion, and Sudanese good ethics.

You are an army officer who has no respect for law, who has no faith in religion, and who for sure has no ethics or morals.

As such, you do not deserve to be an officer in the Sudanese Armed Forces, let alone a commander-in-chief of our national army.

I have further decided as mother of the Martyr Mustafa Awad Khugali to firmly reject, whether from you personally or from your hateful regime, any compensation, reward, or pension that my son Captain Mustafa lawfully deserves as an officer of the Sudanese Armed Forces who served the army with honor and courage and was rewarded with the highest medal of bravery that the Army awards, for his bravery and allegiance to the army, people, and homeland within less than 2 years of his heroic service.

Brigadier killer Omer:

Days ago, the news came from Sudan that you have deliberately planned and executed - behind the back of Mustafa’s struggling family against your murders and savage rule – an evil conspiracy that abused the honor and ethical code of the Sudanese Armed Forces.

You lured one of my son’s relatives who worked for your army intelligence to falsify an application in my name and the names of Mustafa’s family to obtain your regime’s compensation for Captain Mustafa as a martyr of the army.

You unlawfully commanded the army judicial branch to finalize the compensation papers. You falsified the forms to enable that relative to possess the compensation as a bribery to confuse the public so that Mustafa’ s family would cease to press charges for your trial as a killer of Mustafa and the other martyrs, as well as a worst abuser of army rules and authority.

Brigadier Omer Al-Bashir, the killer of my son:

I hereby affirm that your cheap conspiracy to distort the struggle of Mustafa’s family was detected, fully rejected, and made known to the people and human rights groups, in Sudan or in exile, that honestly support the noble cause of the Ramadan martyrs and the human rights of their families.

The mother of Mustafa refuses any cooperation with you or your murderous army collaborators or government agents in any capacity, whatever.

I reject the compensation money you cheaply stole from the army treasury and handed out to a non-representative of Mustafa’s family who wickedly collaborated with your indecent intelligence and judiciary branch and did receive money as compensation on behalf of Mustafa’s family.

I reaffirm that the honor and bravery of my son Mustafa will never be sold out by your dishonorable acts or political decisions of your terrorist regime.

As mother of the martyr, I solemnly pledge, to the last minute of my life, that I will continue to ask for your trial before a just and fair court, whenever that would be available in or outside Sudan.

Signed,

Jara Osman Al-Hussain Sudanese citizen in exile (London) Mother of the Martyr Captain (pilot) Mustafa Awad Khugali Mustafa
